TERMS AND CONDITIONS

Road Trip Organizers (RTO)

These Terms and Conditions (“Agreement”) govern the participation of any rider or pillion (“Participant”) in motorcycle rides, tours, or events organized by Road Trip Organizers (RTO). By registering for or participating in any such event, the Participant acknowledges and agrees to the following:

1. Assumption of Risk

  1. Participation in motorcycle rides inherently involves risks including, but not limited to, accidents, collisions, falls, mechanical failures, adverse weather, road conditions, bodily injury, permanent disability, and death.
     

  2. The Participant voluntarily assumes full responsibility and all risks arising out of their participation.

2. Release of Liability

  1. The Participant hereby waives, releases, and discharges Road Trip Organizers (RTO), its founders, captains, organizers, volunteers, representatives, agents from any and all claims, liabilities, demands, causes of action, costs, damages, or losses (including personal injury, property damage, or wrongful death), whether caused by negligence or otherwise, arising out of or relating to participation in any RTO event.
     

  2. This release extends to any third-party claims resulting from the Participant’s actions during the event.

3. Participant’s Responsibilities

Each Participant is solely responsible for:

  • Possessing a valid and current motorcycle driving license issued by the Government of India.

  • Ensuring their motorcycle has valid registration, PUC, and comprehensive insurance covering rider, pillion, third-party liability, and property damage.

  • Wearing appropriate protective gear including helmet (ISI/DOT/ECE certified), gloves, riding jacket, pants, and boots.

  • Maintaining their motorcycle in safe, roadworthy condition.

    The Participant acknowledges that they are financially liable for any damage caused by them to property, facilities, equipment, or third parties during the event.

4. Rules of Conduct

  1. Participants must follow all traffic rules, safety guidelines, and instructions given by RTO ride leaders/organizers.
     

  2. Alcohol consumption is strictly prohibited for at least 8 (eight) hours prior to the start of the ride until the ride has officially ended.
     

  3. The possession or use of illegal substances or intoxicants is strictly prohibited.
     

  4. Participants must ride in the designated formation, responsibly, and without endangering themselves, fellow riders, or members of the public.

5. Medical Fitness

  1. The Participant affirms that they are medically fit and do not suffer from any condition that may impair their ability to safely participate.
     

  2. RTO is not responsible for providing medical facilities. Any medical expenses incurred during the ride shall be borne solely by the Participant.

6. Cancellations and Refunds

  1. Due to advance planning, bookings, and arrangements, no refunds will be provided for last-minute cancellations or early withdrawal from the ride.
     

  2. Refund policies, if applicable, will be mentioned in the specific ride announcement and shall be final.

7. Breakdown, Damage, and Accident Policy

  1. In the event of mechanical failure or accident, the Participant is responsible for the repair, transportation, or towing of their motorcycle.
     

  2. RTO may provide assistance, subject to availability, but all costs associated with recovery, repairs, or transportation shall be borne by the Participant.

8. Media Consent

  1. The Participant grants RTO a perpetual, worldwide, royalty-free license to use photographs, videos, or other media captured during the ride for promotional, editorial, and social media purposes, without any compensation or prior approval.

9. Governing Law & Jurisdiction

  1. This Agreement shall be governed by and construed in accordance with the laws of India.
     

  2. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai.

10. Declaration & Acceptance

By registering for or participating in any event organized by Road Trip Organizers (RTO), the Participant affirms that:
 

  • They have read, understood, and agreed to the above Terms and Conditions.

  • They accept full responsibility for their participation and all associated risks.

  • Their presence at the ride or event constitutes binding acceptance of this Agreement.
